Termination of Pregnancy

The concept of termination of pregnancy includes a spontaneous or intentional medical termination of pregnancy, a stillbirth or a stillborn child.

In the event of a termination of pregnancy, you may be entitled to:

  • maternity benefits or exclusive benefits to the person experiencing pregnancy or childbirth
  • exclusive benefits to the woman or the person experiencing pregnancy or childbirth, in the case of a surrogacy project.

This termination must occur after the 19th full week of pregnancy. Subject to exceptions, the benefit period ends no later than 20 weeks after the week when the termination of pregnancy occurs. 

Termination of Pregnancy After Applying for Benefits

You must quickly call the Centre de service à la clientèle at 1-888-610-7727 so that we can update your file. An agent can ensure that you will receive all the benefits to which you are entitled. 

Maternity Benefits or Exclusive Benefits to the Person Experiencing Pregnancy or Childbirth or, in the Case of a Surrogacy Project, Exclusive Benefits to the Woman or the Person Experiencing Pregnancy or Childbirth

Termination of pregnancy has no effect on payment of these benefits, because they concern your recovery from pregnancy or childbirth.

Termination of Pregnancy Before Applying for Benefits

If you need support in your process, contact the Centre de service à la clientèle at 1-888-610-7727. An agent can explain the benefits to which you could be entitled, depending on your situation. You may apply and your eligibility will be evaluated when the application is processed. 

Maternity Benefits or Exclusive Benefits to the Person Experiencing Pregnancy or Childbirth or, in the Case of a Surrogacy Project, Exclusive Benefits to the Woman or the Person Experiencing Pregnancy or Childbirth

Termination of pregnancy after 19 full weeks of pregnancy may entitle you to these benefits, because they concern your recovery from pregnancy or childbirth.

The table below indicates the maximum number of weeks of benefits that can be paid and the percentage of average weekly earnings, depending on the plan chosen.

 Pregnancy and birth (excluding surrogacy)

Maternity or exclusive to the person for pregnancy/childbirth  

Maximum of 18 weeks.

Weekly benefit: 70% of the average weekly earnings

Maximum of 15 weeks.

Weekly benefit: 75% of the average weekly earnings

 Surrogacy
Exclusive to the woman or the person experiencing pregnancy or childbirth

Maximum of 18 weeks.

Weekly benefit: 70% of the average weekly earnings

Maximum of 15 weeks.

Weekly benefit: 75% of the average weekly earnings
